Legal Proceedings Underway for Bylaw Infractions

Duncan, BC – The Cowichan Valley Regional District (CVRD) has started a petition in the BC Supreme Court against a property at 3170/3172 Shawnigan Lake Road. The CVRD is requesting a declaration that the owners’ use of their property does not comply with the CVRD’s Zoning Bylaw as it is currently being used for the milling, processing and storage of wood and wood products or for the storage of lumber, logs, wood, equipment and machinery.

The CVRD is requesting a declaration that a building was constructed on their property without first obtaining a required building permit.

Through the petition, the Regional District is also requesting the court grant an injunction requiring the owners to cease using their property in a manner that does not comply with the Zoning Bylaw, as well as an order they remove from their property the building that was constructed without a permit.
